1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and the poemtograph team ("we", "our", or "us"). These Terms govern your access to and use of the poemtograph mobile application and our website located at https://poemtograph.app.

By creating an account, downloading the application, or otherwise using any part of the service, you agree to be bound by these Terms. If you do not agree with these Terms, you may not use poemtograph.

2. Description of Service

poemtograph is an AI-powered creative software suite designed to analyze user-submitted photographs and compose original poetic verses in various literary styles. The service includes image composition, typography formatting, in-app sandbox gallery management, and digital art export tools.

3. Ownership & Intellectual Property

• Your Photos: You retain complete, unrestricted copyright and intellectual property rights in all photographs you choose to import into poemtograph. We claim no ownership over your photos.
• Generated Artworks: Subject to your compliance with these Terms, you are granted full commercial and personal rights to share, publish, print, and distribute the composite poem cards and poetic verses you generate using poemtograph.
• Application Rights: The design, logos, brand assets, typography systems, source code, and underlying software algorithms of poemtograph remain the exclusive intellectual property of the poemtograph team.

4. Credit Ledger & Consumption Rules

Generative inference operations are powered by a credit ledger system:

• Complimentary Credits: New users receive 10 free credits upon installation to explore the service.
• Atomic Deductions: Credits are only deducted after poetry inference has completed successfully and your artwork is saved locally. If generation fails due to a network interruption, zero credits are deducted.
• Extra Credit Packs: Non-expiring consumable credit packs (e.g., Extra 10 Pack) do not expire and remain active in your account indefinitely until consumed.

5. Subscriptions, Renewals & Cancellation

• Billing Cycle: Subscriptions (Pro Monthly and Pro Annual) are billed in advance on a recurring schedule through your Google Play Store account.
• Rollover Guarantee: Unused subscription credits automatically roll over at the end of each billing cycle for up to three (3) consecutive months. When generating poems, older rollover credits are consumed before current-period credits.
• Cancellation: You may cancel auto-renewal at any time through your Google Play account settings (Google Play > Payments & Subscriptions). Upon cancellation, you retain full Pro access and existing credits until the conclusion of your current paid billing period.
• Plan Switches: Upgrades and tier adjustments take effect immediately in accordance with Google Play Billing rules, resetting your monthly credit quota and ensuring all unconsumed credits are preserved.

6. Acceptable Use Policy

You agree not to use poemtograph to upload, generate, or transmit:

• Content that is unlawful, defamatory, harassing, abusive, threatening, or harmful.
• Non-consensual sexually explicit or intimate imagery.
• Content that infringes upon the intellectual property or publicity rights of any third party.
• Automated scripts, bots, or unauthorized scraping mechanisms designed to bypass credit limits or overload our infrastructure.

7. Disclaimer of Warranties

poemtograph is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, statutory, or otherwise. While we strive for exceptional aesthetic quality, we do not warrant that generated poetry will always be error-free or perfectly suited for any particular purpose.

8. Limitation of Liability

To the fullest extent permitted by applicable law, the poemtograph team and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the service.
